I received a call the other day from one of my insureds.  Apparently, my insured’s wife was being followed by someone who claimed her car kicked up a rock and hit his car.

Well, being followed by anyone these days is scary.  My insured’s wife was on her way to visit her husband at work for lunch.  So, when she reached her destination the other driver stopped and confronted her about the claim.  My insured’s husband was there and said this other driver was forceful and demanded he pay half the cost for the repair.

Well, after my insured explained the situation to me I offered to call the other party and tell him that he needs to report and make a claim with his insurance company.  The claim would be considered ‘road hazard’ or ‘acts of God’.  This is not a collision and there is no proof that any one particular car  kicked up the rock.

Did the other driver do something wrong?  The anwser to that is yes and no.  No, because he felt he needed to get a license plate in case there is a claim and yes, because you can’t follow someone for road hazard and accuse them of causing a rock to kick up and hit your car.

The best choice is to get a license plate if you feel you have a claim and report the information to your insurance agent or claims representative.  The insurance professional will let you know if you have a claim.
